1. For the effect of this contract, “ticket” means “ticket for traveling and baggage control” from which the following conditions and notices have part; “carrier” or “conveyor” means all airline that transports or that is committed to transport a passenger or its baggage pursuant to this contract or that carries out any other service related to this air transportation; “electronic ticket” means ticket for traveling magnetically registered and in this case, forwarded the Boarding Pass, it represent the ticket for traveling.
2. The ticket for traveling evidences the celebration and acceptance of the conditions of the "Contract of Air Transportation of LAN Argentina" ("the Contract") concluded between the carrier and the passenger whose names appear cast in this ticket.
3. The name of the carrier may appear abbreviated in the ticket, provided that the full name and the abbreviation appear in the conveyors tariff, manuals, conditions of carriage, regulations and/or itineraries. The agreed scales are those mentioned in the ticket for traveling or, in the absence of them, those that appear in the conveyors itineraries as predicted scales in the route of the passenger. The transportation to be performed under this contract by several conveyors, successively, is considered as a single operation.
4. A carrier that issues a ticket for transportation in segments of another air carrier, serves only as an agent.
5. Any exemption or limitation that is responsibility of the carrier will be applied and will go in benefit to carrier agents, employees and representatives and to any person whose aircraft is being used by the carrier to perform the transportation and to its agents, employees or representatives.
6. The carrier may refuse the transportation if the applied fare has not been paid or if the ticket has been obtained illegally. In the same way, the carrier will deny the boarding of a passenger or will arrange the getting off of the passenger if he considers that the passenger can affect the safety of the flight or passengers.
7. The carrier commits to do everything possible to transport the passenger and its baggage in reasonable punctuality. Times indicated in the itineraries or in any other publication are not guaranteed regarding its fulfillment and are not part of this contract. In the case needed, the carrier, without previous notice, may request another carrier to substitute him or change the material of flight and alter or omit stops indicated in the ticket if it is needed. Itineraries are subject to changes without previous notice. The carrier does not assume responsibility to guarantee connections.
8. Every passenger that do not present to travel or that arrives late to his/her boarding, will lose his/her ticket, or will be able to revalidated for another date if the fare paid allows this.
9. No carrier’s agent, employee or representative has authority to alter, amend or waive any arrangement of this contract.
10. Vouchers of the ticket must only be presented to and accepted by the carrier, in the correlative order indicated in the ticket.
11. Conditions that correspond to the fare will be additionally applied to the ticket, regarding changes of dates and names, revalidation and return, which the passenger declares to know due information provided previously.
Hazardous articles within luggage
1.The carrier will deny the transportation like baggage, carry-on or checked in, of those dangerous articles and substances that can constitute a significant risk for health, safety, or property, such as:
2. In order to ensure the safety of the flight and comply with the rules in force, the carrier and the security personnel from the airport, may make withdrawal, to proceed with the destruction, of dangerous articles and substances transported by the Passenger or in his/her carry-on luggage.
3. There is a limited humber of medical articles and toiletries which passengers shall be allowed on board. Before putting them in your luggage, kindly verify with company staff.

4. Many of the articles mentioned above, can be transported by air under some especial conditions, protected by a bill of lading and under a fare of air cargo.
Baggage Allowance
It will be understood by baggage only the personal effects needed to make the trip.

Those packages that weight more than 45 kg and/or its size is bigger than 203 cm (length + height + width) should be shipped as cargo, paying the respective freight. For routes to Europe, Oceania and connections with Iberia, British Airways and Qantas, the maximum allowed weight is 32 kg.
The allowed baggage may be changed regarding fare conditions, cabin and route, and will be expressed in packages. The carrier reserves the right to modify these franchises and the size of baggage. Contract conditions and fares are registered with the concerned aeronautical authorities. Ask for baggage franchise and payments that will affect the excess baggage directly with your airline or at www.lan.com
For any excess, the carrier may charge fees over such franchise.
As a precaution and security, only one piece of baggage is allowed to be carried on cabin, with dimension and weight that enable them to be placed at the upper compartments of the aircraft or under the seats. This package may not exceed 8 kg in Economy class or 16 kg in Premium Bussines or Premium Economy class and its dimension may not exceed 115 cm (55 cm long + 35 cm high + 25 cm wide).
Excess of reservations notice
In the case of excess of reservations, it may be that some flights have reserved more seats than the real capacity of the plane and, therefore, a seat may not be available for a passenger with a confirmed reservation. In this case, and after trying to overcome this situation, what considers requesting passengers to freely return their confirmed reservation, the company may be forced to deny the check-in of a passenger, who will have the right for a compensation, if he/she has presented to the check-in counter in advance to the departure time. In the case of excess of reservations, local legislation, fares and conventions will apply.
Non smoking
The company has established that in all its flights it is not allowed to smoke.
Notice
If the trip of a passenger ends or has a stop in a country different to that of the departure, the Warsaw – The Hague System will apply, which will rule, when appropriate, the responsibility limits of the carrier in case of personal death or injuries and the loss or damage to baggage. Also see the notice “International Passengers Notice regarding responsibility limit” and “Responsibility limitation notice about baggage, which are made available to passengers by the Carrier”.
Especial conditions of the contract of international transportation
1.The transportation made pursuant to this contract is subject to the norms and limitations related to responsibility established by the Warsaw – The Hague System, unless the transportation is not “International transportation” as explained in such convention.
2. Even though to the above, transportation or other service that each carrier provides is subject to : (I) the provisions contained in the ticket; (II) conditions established about the applicable fare; (III) the conditions of transportation established by the carrier and other related regulations which are part of this contract (and that can be requested in offices of the conveyor), except in the case of transportation between a point within the United States of America or Canada and any point outside these countries, for which the valid fares in them applies.
3. The checked-in baggage will be delivered to the bearer of the baggage voucher. In case of damage in the baggage in international transportation, the claim must be presented on writing immediately after discovered the damage and, at most, within 7 days after received the baggage; in case of delay, the claim must be done within 21 days following the date of the baggage deliver. For the purposes of the preceding paragraph, it is understood by "Delay" any delay that happens in the reception of baggage and which has been produced by direct responsibility of the Carrier.
4. The ticket is valid for one year since its issuance date, unless other thing is indicated on it, in the carrier fares, in the conditions of carriage or regulations related. After this period, this ticket lose its value. The fare for the transportation under this contract is subject to changes before starting it.
5. Passenger must comply with the requirements for traveling imposed by any authority and must submit the exit, entry and other required documents.
6. Flights between Madrid and Frankfurt and vice versa with LAN are considered No-Schengen (no intracommunal) flights by authorities, therefore passengers belonging to these flights will have to submit mandatorily to custom and passport control. It is obligation and responsibility of each passenger to carry the required documentation. LAN Ecuador is not liable for damages and detriments caused by the passengers failure to comply with this obligation.
7. Passenger must present at the check-in counter at the time that the carrier informs, and if no time has been set, should present with enough anticipation to comply with the exit procedure, what may not be inferior to 02 hours before departure time.
International Passengers Notice regarding responsibility limit
1. Except as noted in any treaty or applicable law, the civil liability of LAN on international flights, can be regulated by the so-called Warsaw - The Hague System.
2. LAN declares that in every transportation regulated by the Warsaw – The Hague System, will not invoke the civil liability limits prescribed in its article 22(1), in the claims for countervailing damage that appear for personal death or injuries. In this case of claims LAN will not make use of the defenses of article 20(1) of the Warsaw - The Hague System, regarding those claims that do not exceed the 100,000 DEG (SDR). Except for what included here, LAN Ecuador will be able to make use of the rest of the defenses provided in the Convention and of the appropriate resources against third party.
3. For flights operated by LAN to and from the European Union, LAN without delay and at the latest within 15 days following the determination of the identity of the person entitled to claim, will carry out the money advances as countervailing and that are required to attend the needs of the person with the right of indemnification, in proportion to the damage suffered. Such advances do not imply under any circumstances acknowledgment of responsibility, may be compensate with the pay of future sums, but are not refundable, except when the damage has been caused in whole or in part by the passenger or by the person that receives the countervailing, or when this last one had not the right to be indemnified.
Notice of responsibility limitation for baggage
Responsibility of the carrier for the loss, delay or damage of the baggage is limited by international agreements related to international air transportation, it may be by the Agreement for the Unification of some rules related to International Air Transportation subscribed at Warsaw, modified by Protocols of The Hague and Montreal, or by the Agreement for the Unification of some rules for the International Air Transportation signed in Montreal, Canada on May 18, 1999 as applicable. Regarding articles of high commercial value and electronic devices, it is recommended that passengers carry this packages as carry-on luggage as possible, in order that passengers keeps custody of them, since carrier will not respond for them beyond the limits established by law.
